[343] There is a John Stewart age 8 born in Texas listed in the household of Nancy Stewart age 47 born Tenn., listed on the 1850 Titus Co. Texas census. Unknown if this is he correct John Stewart.

He was a Texas Ranger and a US Sheriff.
On his last assignment, he was sent to capture 3 horse thiefs about 30 miles south of Gainesville. He captured the men and was bringing them back to Gainesville, when he stopped for the night to camp with a wagon train. He tied the prisoners up underneath the wagon. Stewart was making coffee at one of the campfires when one of the men freed himself, untied the other two, and got his double-barrelled shotgun. The outlaw then shot Stewart in the back, killing him instantly. The renown US Marshall Pat Osborn, when hearing of this, set out to capture the three men. He was gone over a month, and returned leading 3 saddled horses with 3 pair of shoes tied in the saddles, along with the double-barrelled shotgun. When asked about the men, he replied that "they got away". Later he confided to Arraminta Bailey Stewart that he had taken care of the matter himself, because "Mac" Stewart was the "best man and friend he ever had."
